1. General
1.1 Dreifeder is a brand owned by Andtex GmbH. These Terms of Service ("Terms") govern all business relationships, including all orders placed via telephone, fax, internet, email, or postal mail, between Andtex GmbH and its customers (hereinafter referred to as "Customer" or "Buyer"). The version of the Terms valid at the time of order shall apply. These Terms also apply to future business transactions, even if not explicitly agreed again. By placing an order, the Customer accepts these Terms.
1.2 Deviations from these Terms are only valid if confirmed in writing by Andtex GmbH. Terms and conditions of the Customer do not apply, even if Andtex GmbH does not explicitly object to them. Any counter-confirmations by the Customer referring to their own terms are hereby expressly rejected.
2. Offer and Conclusion of Contract
2.1 The Customer's order constitutes an offer to Andtex GmbH to conclude a purchase contract. Upon receiving the order, Andtex GmbH will confirm receipt via email (Order Confirmation). This confirmation does not constitute acceptance of the offer. The contract is concluded only when Andtex GmbH accepts the offer, either by email confirmation of dispatch or by shipping the goods. Andtex GmbH may accept the offer within two weeks of receipt.
2.2 Andtex GmbH only enters into contracts with legal entities and individuals with full legal capacity who are of legal age. If it is determined that the Customer is a minor, Andtex GmbH reserves the right to withdraw from the contract.
2.3 Andtex GmbH reserves the right to withdraw from the contract if suppliers fail to deliver correctly or on time. The Customer will be informed immediately of the unavailability, and any payments already made will be refunded.
2.4 If a product is unavailable, Andtex GmbH may offer a replacement of equal or greater value and quality. The Customer may accept or reject this offer.
2.5 All information in sales documents or on the website (images, drawings, dimensions, weights, product descriptions, prices, and other services) are approximate and not legally binding unless explicitly confirmed in writing.
3. Prices and Costs
3.1 All prices include applicable Swiss VAT and shipping costs. The prices at the time of order apply. Prices listed on dreifeder.com or in sales documents are shown in the applicable currency.
3.2 The Customer bears any additional taxes, duties, or fees for deliveries outside of Switzerland, Germany, Liechtenstein, or Austria. These are not included in the listed prices.
3.3 Shipping costs are included in the product prices.
4. 14-Day Return Policy
4.1 Customers may return items within 14 days at their own expense.
4.2 Worn or damaged items that cannot be resold will not be refunded.
4.3 The Customer must cover all return shipping costs.
4.4 Returns will be inspected upon arrival. If items meet return criteria, refunds will be issued via the original payment method.
4.5 If a 10% discount was automatically applied for orders over CHF 200 and the return reduces the order value below this threshold, the discount becomes invalid, and the difference will be deducted from the refund.
4.6 Additional costs incurred by Andtex GmbH due to the return will be charged to the Customer. An administration fee of CHF 20 per return will apply.
5. Payment Terms / Retention of Title
5.1 The purchase price becomes due upon order acceptance and order confirmation by Andtex GmbH.
5.2 Payment methods available at the time of order apply.
5.3 Discounts or early payment reductions (skonto) are not permitted.
5.4 Payments are considered made only when Andtex GmbH has full access to the funds.
5.5 All deliveries remain the property of Andtex GmbH until full payment is received, including any additional charges.
6. Purchase on Invoice with Installment Option (PowerPay AG)
PowerPay monthly billing allows online purchases to be paid via invoice with an installment option. MF Group / PowerPay is an external payment provider handling this service. When using invoice payment, the Customer also accepts PowerPay's terms: powerpay.ch/de/agb.
7. Delivery Conditions
7.1 Deliveries follow the shipping terms valid at the time of order. Items are delivered to the address provided by the Customer. Delivery times are not binding.
7.2 After the first delivery attempt, the risk of loss or deterioration of the goods transfers to the Customer.
7.3 Partial deliveries are permitted if reasonable for the Customer.
7.4 Delays due to force majeure (e.g. strikes, government actions, or supplier issues) do not constitute grounds for claims. Andtex GmbH may delay or cancel the order under such circumstances.
7.5 If the Customer fails to accept delivery or violates obligations, Andtex GmbH may claim damages.
7.6 The risk of accidental loss or damage transfers to the Customer once they are in default of acceptance.
8. Right of Withdrawal
No statutory right of withdrawal applies.
9. Liability and Warranty
9.1 If the product is defective, statutory warranty rights apply unless stated otherwise.
9.2 Andtex GmbH is only liable for damages caused by simple negligence if a fundamental contractual obligation is violated. Liability is limited to foreseeable typical damages and the order value. No liability for lost profits.
9.3 Other statutory liabilities (e.g., intent, gross negligence, or product liability) remain unaffected.
9.4 These limitations apply to third parties within the contractual scope.
9.5 Legal representatives and agents of Andtex GmbH are subject to the same liability limitations.
9.6 Warranty claims are initially limited to rectification. If rectification fails, the Customer may withdraw from the contract or demand a price reduction.
9.7 Defects must be reported immediately by email. Failure to report on time voids warranty claims. Andtex GmbH will only offer replacement deliveries. Multiple attempts at rectification are permitted. Further claims are excluded unless replacement fails.
10. Complaints, Governing Law, Jurisdiction
10.1 All complaints must be submitted in writing to the company’s address.
10.2 Swiss law applies, excluding the UN Sales Convention (CISG), even for international orders.
10.3 The place of jurisdiction is the registered office of Andtex GmbH.
11. Customer Reviews
By submitting a review, you grant Andtex GmbH a non-exclusive, unlimited license to use it. Andtex GmbH may edit, shorten, or remove reviews. Reviews reflect only the author's opinions.
12. Data Protection
The collection and use of personal data are explained in the Privacy Policy, which forms an integral part of these Terms. By agreeing to the Terms, the Customer acknowledges the Privacy Policy.
13. Final Provisions
13.1 Offers are non-binding and subject to change.
13.2 Andtex GmbH aims to represent all products accurately. Slight variations due to materials or handcrafting are possible.
13.3 These Terms represent the full agreement between Andtex GmbH and the Customer. Amendments require written form.
13.4 This version replaces all previous versions.
14. Severability Clause
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected. Invalid provisions shall be replaced by legally valid ones that best reflect the original intent.
